Hi! I have some questions:
1. Do you have a lawyer when you filed the first MTR or did you do it by yourself?
2. Did you submit a copy of the I-140 approval and the AC21 memo during MTR?

1. Yes, I have been having an attorney all the way thru the two MTRs
2. Yes, I-140 approval copy was present in my first MTR. My first MTR did not have AC 21 memo. AC21 memo (2003 Yates Memo) was present in my second MTR when we filed it. Of course, I-140 approval copy was there in the second MTR.

I've sent 7001 to Ombudsman , Contacted Congressional offices and ultimately filed a Service request in Nov 1st week. After all this NSC opened my case yesterday Dec 9th and the status changed to "RFE sent" - there you go ! They bought at least 2 months extra time.
What a bunch of jokers at NSC - my case was extremely straight forward :(

1)I disagree with the bill, why should legal employment immigration pay for policing the border. Why only H1 and L1s? Why not other temporary and permanent immigration visas
Should not they be paying to protect the border first before everything else
2) Having said that, I cannot disagree with making it difficult for companies which have more than 50 employees with more than 50% on h1/L1. It just does not add up that they cannot employ 50% locals/residents. I would go further and make it really difficult for someone to do this unless they can really prove the need (like in case of EB1)
I know my opinion will not be popular, but think about it. I can agree they cannot fill all their jobs with locals, but not even 50%, come on some one will have to show me why they can not do that. The only reason I can think of

3)They come here for a short duration to help outsource the jobs

Actually it was lost by only 2 votes. Only 95 Senators voted and hence 57 votes would have been enough to carry it through. Really Sad. :(
That only 57 is required is not correct. The vote needs 60 to pass the motion. If no is totaling up only 37 but if yes is 59 still then it would not pass. Also if the senator is absent then it is considered a NO vote.

Its hurting to see that no major movements in jan bulletin. :mad:
Sad story continues. Only EB3 moved by 1 month surprisingly.
There is a chance that during this year, EB2 might become unavailable too.

I read in one of the Ron's post -CHc trying to stop even small immigration bills which has no amesty in it.So even the nurse recapture bill is at stake.
So ,I'm sorry -I beleive no one will even touch our case.Apply in EB2 port PD or get new PD either will be helpful .But seeing new backlog for I 140 its terrible.
I might apply for Canadian GC-Having kids here ,man they are adapted to this country living.That's the only thing bothering - kids future.
So this bill this year is at stake for sure.No one cares ...including change-what change there woudnt be any change in new party too.Its all drama going.I lost the trust.Its as if EB3 is not educated.
I'm just wondering-Will this problem be there if it were for ROW-or is it our color...that they dont want to aid.It's sure racism.
How many EB3 are there in total...Who asked them to flood the applications last year? :mad:
Its bloody hell out here.no wonder some people become saddist later half ...who woudnt when they are treated like this from begginning.
Now I have to hate myself applying in EB3.:rolleyes:
EB2 guys have been diverted from participating in any campaign now.so no bothering congressmen.
I have mailed to Senator Menendez -NJ thanking him for introducing the new bill and to do the needful.So far no news.

Why would it work against? After all, is H1-B is a dual intent visa...
Only lawyer or the employeer contact can call for labor status queries. DOL does not know you exist. Be careful there is no relation between labor and green card AOS. If you call it shows that you intend to immigrate while on H1. It might work against you.

Hello 9years: Thanks for sharing the info all along. A quick question:
I got my EB2 Labor certified today, and now my lawyer is preparing EB2 140 as an interfile into my existing EB3 485.
Is this recommended or should we do regular premium 140 and request date porting once its approved?
If we do decide to do interfile now during 140 application. Is it advisable to do premium processing?

If you are determined to make sensational calculations and postings then who can stop you, but seriously stop assuming things.
1st assumption: 750000 applicants (realistic figure near 500,000)
2nd assumption: all are adults (why would kids need EAD, and there would be several in that category)
3. it takes only 5 mts could take more or less who knows,
4. work hrs
5. number of people.
Stop being so negative and sensationalizing everything. There are more genuine problems to talk about.
