My H1 stamping has expired. I have traveled using AP before. Just wanted to know if anyone traveled back with AP via Brussels?
Email I received from Belgium consulate just says "Indian nationals do not need transit visa". I am sure it means they do not bother about H1/AP as long as you have legal entry for the destination. Just wanted to re-check.

With my knowledge, I don't think your current salary should matter for the future employement. But it shouldn't be grossly differrent. One of my friend got his GC approved with H1B salary less than salary mentioned in I140. What I would like to say is not worry to about it much until your attorney says it is a problem.

I'm currently on my amlost 6th year of my H1B. I have my i-140 (Still valid) approved from my previous employer under EB3. I'm applying for a new PERM with my current employer and I would want to apply in EB2. I hold 3ys bachelor's degree with 12 yrs of experience. My attorney says that chances are either my PERM or I-140 will be denied based on my education qualification.
I'm looking for your advice on the following.
1) I heard that I can apply for 3yr extn based on my previous I-140. Considering that is it worth the fight on EB2. I'm looking to port my PD (Nov 2008) to this I140 if approved.
2) My company sponsers two PERM to be applied, so it is worth to try for EB2 and later if denied on EB3. Will this affect my H1B extensions? say if it's get rejected on EB2, am I not eligible to apply for H1B extension with my current employer, since my labor/i-140 is denied.
Please help. I'm just not able to get this over my head :(

In Mid 2007, 7th year of H-1B tansfer & extension was filed, and was no problem as I had an approved ETA-750 with ex-employer, but it was expired soon as the sponsor�s (ex-employer) company was closed at the end of 2007.
The 7th year approval period was 12/11/2007 ~ 12/10/2008 with the current employer.
I filed another labor certification (ETA-9089) on 10/23/2007 which was sponsored by my current employer, and it has not been approved yet.
Using this ETA-9089 pending more than 365 days, I filed an I-129 extension for 8th year of H1B last November 2008, but INS sent "Request For additional Evidence Sent" letter which was saying to be provided �An evidence of pending / being processed for more than 365 days of labor certification or I-140 prior to 6 year expired of H-1B�. we just realized that a memo was posted regarding this on 05/30/2008.
As I don�t have this evidence... Please advise or recommend me...

I am on H1 and working at client place, my parents visited few months back. Some of my friends(who are at client place) in-laws/parents also visited. As long as you produce documents specified, there wont be any prblm with visitor visa.

Hello,
I e-filed my AP on March 4th ( this was my 2nd AP application; the first one was paper file in July 2007)
When i check the case status online it gives me a message "your case can not be found".
Any idea what it might be?
I tried several time calling the 1-800 service number but I am not getting to talk to a real person.

One of my friend got their Fingerprinting letter and the last name is misspelled. What should they do go ahead and take it to the FP office or call USCIS and get it corrected.

The storyline continues. Last year, 13,500 regular H-1B applications were counted in the first week and 5,600 advanced degree applications. This year 5,900 regular applications were received in the first week and 4,500 advanced degree petitions. USCIS just reported that in the second week of counting, 7,100 regular cases were receipted and 5,100 advanced degree applications. it might be a little bit tricky to find this out. Talk to IO about your 485 and ask her about 140 during the conversation. She might tell you the PD on that. Once, I successfully reconformed my PD by trying this way ( I have approval notice with me though).

I am here on L2 and then Joined a Company in 2006. When I joined, that time the H1 Cap 2007 was already over so my company said that they will do my H1 this year. Unfortunatly I got the H1 Rejected as my case couldnt get in the lottery.
In the Mean time my company have filed my Green card under EB3 and we have I-140 Approved (1 st stage) in August 07.
Now, is there any way that anyone can Help me?
