I think u can as long as prior employer does not revoke i140, please consult a good attorney
Current situation :
Labor approved(eb3 with pd of July 03),
I140 in process,
In my seventh year of H1b on a one year extension expiring in August.
Please advise if I can change employers now and still get a new H1 though I am in my seventh year ?
Thanks

I heard that if the current state u work in State A , is not the same as the one labor was filed - State B , then it can trigger an RFE.
My Q is HOW frequent is this possibility ? Has anyone experienced this ? Also my PD WILL Be current next month and I filed AR 11 about 10 days ago . Will that impact ? I read somewhere someone posted an article that change of address can tigger RFE at 485 Stage. But changed address in the same State B , I have been working in since 2008 ( I filed 485 in 2008 from State B ) . The change of address is only some 20 miles away from the previous one.
Any clues .. folks ? thanks

USCIS kept on updating the total number of cases received for H-1B for FY 2009-10. However, the recent USCIS H-1B (http://www.h1b.biz/lawyer-attorney-1137085.html) cap count indicates decline in number of cases than what had been previously reported. The updated count reports the receipt of 44,400 Regular cap cases, by June 12, 2009 which is lesser than the prior count of 47,700, given as of May 22, 2009. There is no explanation too from USCIS for this decline in trend. Thus, this reduced number may reflect either withdrawals by employers, denials by the USCIS, duplicate filings, or an error in the prior cap counts.
As of this writing, both the Advanced Degree and Regular caps remain open. We will continue to provide updated H-1B cap count information.

Hi all,
Mine is Labor Substitution with EB2 India PD is April 2005 and with the same Employer since 5 years .
6 months back my case was moved to New York (I am working in NY as a consultant ) regional center where I am working now.
I have to move to NCarolina this month end for a new assignment. What should I do now?
If I inform USCIS thru AR-11, how much time they take to transfer my case to new regional office? Worried if they take long time and dates retrogress before they transfer.
How early can I apply AR-11 and how late I must inform them?
Anybody with similar experiences? Pleas suggest me the due course of action.

hi,
As far as I know you do not need to get a new visa stamping. At least, it was like that when I was on F-1. What you need to re-enter is to have I-20 from new school. Check with the school's international students adviser.

You can do it yourself. Its easy with e-filing and so many (including yours truly) in this forum have done it. Check out this thread for more info:

And please contribute that attorney fee to IV :)
Is it easy to do that myself? Or do I need to go through an attorney?
Please advise.
Thanks!

Regarding coming back on F1 after being on H4... You should really consider talking to an attorney. With F1 visa you need to prove that you would come back to India at the time of stamping, but with your spouse being on H1 and in states.. how do you thing you can prove that you will come back to India when your spouse is in the states..

I have an H1B approval from USCIS, and I am trying to go to Canada for the initial visa stamping. But then i have a problem. I initially entered the country as a visitor, and married a citizen, but only after my I-94 had expired for about a week. (My petition is still pending. The company I am working for could not wait for my greencard, since its already been years since I started that process, so they went ahead and applied for the H1B visa for me). I heard that it is a problem to do the visa stamping in Canada if you have been out of status before. Is it advisable to go to Canada for the visa stamping?

No, you don't need the I-864. The interview letter that you got might refer to an I-864, but this is often because the local district office has standard interview letters and they are more often for family cases than employment cases. I've seen this happen often.

Just got an email from Expedia.com - fares from Bay Area to Wash. D.C. have dropped by about $50 - the cheapest fares today (9/06/2007):
- SFO - BWI (US Airways) $208
- OAK - DCA (ATA): $218
- SJC - BWI (Continental): $218
The fares shouldn't be a reason to not participate in the rally! Hope to see more folks from CA - Norcal & SoCal.
cheers!

From the NY Times: Seeking to inject their views into the revived debate over immigration overhaul, several big-city police chiefs urged Congress on Wednesday to draft a new policy that improves public safety by bringing illegal immigrants out of the shadows. The chiefs updating recommendations made in 2006 by the leaders of more than 50 urban police departments called for an overhaul that would integrate immigrants into the legal system, possibly with drivers licenses, and separate the local police from immigration enforcement. Were in the business of delivering a police service whether the person has had a car...
