I belive you are good to go based on WES evaluation.
Just make sure your documentation shows 16yr education leaving MBA.

For applying green card...you don't need any special work visa like h1b etc.. What you need is a sponsorship for your greencard under EB2/EB3 categories. You can research more on that in this forum and also at immigration.com website.

I have a question regarding AC21 portibility. I got my EAD in Oct 12th 2007. In the labor(used a pre-approved labor), the base pay mentioned is 48K and I was getting paid 55K from my current employer(A) who filed my green card.
I am getting another job in company (B) in the same field. The salary offer is better but is very high than mentioned in my labor. The new salary is around 85K.
1) Will the high salary will cause any issue with green card process if I take AC21 and use my EAD. Anyone had this kind of experience with the salary difference.
2) How do I know my new job is in the same or similar category as defined by USCIS.
3) Is AC21 is safe to take.

My I140 (Bachelor degree, EB3, PD: Nov'04) was approved last month from my previous employer.
I completed my MBA in Jun'06 and joined another company; my job description has changed totally and I can't use previously approved labor for my new job. My new employer will initiate the process of labor, next week.
I checked with my previous employer and he informed me that he is ready to give me a support letter, if I want to go ahead and file I485 based on EB3 I140.
Questions:
Is it possible to file I485, even if we are not working with the employer?
Once I have filed I485 based on my EB3 I140, and if the application remains pending for next 6 months, is it still possible to port the PD (Nov'04) to the new EB2 based petition?

1. I came to USA last year on H4
2. Filed H4-H1 in May 2005 through Company A
3. In Dec 2005 my company ( A) got merged with another company ( B)
4. My H1 got approved in Jan-06
5. Presently I am working and getting pay stubs for the new company -- B

Interim EAD's are no longer an option since Sep 2006
In case of emergency travel it is possible to get AP from local office
But in case of extreme emergency like death in the family, funeral etc

A piece of good news on immigration was largely overshadowed by the Arizona mess. Republican Senator Richard Lugar of Indiana and Democrat Dick Durbin sent a letter to DHS Secretary Napolitano urging her to stop the deportations of students who might be eligible for relief if the DREAM Act or comprehensive immigration reform should pass. DREAM would allow some who entered the US as children to obtain permanent residency if they attend college or join the military. No word yet on how Napolitano reacted.

Yesturday night, I saw Charlie Rose Show, in which he first interviewed Andi Carr and then RAHM EMANUEL Representative (D-IL)....
In the middle of conversation, Charlie asked Rahm about what Dems agree and disagree and how they will work with President. He replied that there is no all disagreement. He said Dems agree on Tax reform as well as Immigration. Then he went on to talk about favoritism to CIR.
It seems like winning the election even while being on Immigration side as well defeat of Representatives J.D. Hayworth and Randy Graf (Hardcore Immigrant Haters) have embolden Dems that Immigration is not as taboo as it was once thought. I have a feeling that they will get this done sooner than later. :)
