    Guys, I could use some suggestions here. I had filed for my and wife's EAD on July 30th. My wife wasn't working and my EAD is valid until mid-November. However recently my wife got a job offer and will starting work next week. Her EAD actually expires 15th Oct. Reading through posts it seems that the chances of her receiving EAD approval within 75 days is highly unlikely. Can anyone give suggestions on what is the best course of action to follow to ensure she doesn't have to take a break soon after joining?

    Government Does U-Turn on Green Cards

    WASHINGTON -- The government did an about-face Tuesday and announced it is accepting applications for green cards filed by skilled immigrant workers.

    Citizenship and Immigration Services, a division of the Homeland Security Department, said in a news release it will accept the applications through Aug. 17. Applications already filed, which the agency planned to reject, also will be accepted.

    Senior members & Experts , please clarify on this issue

    1. I'm AOS aplicant currently working with company X in US and planning to go to abroad and work for other employer Y for 1 year in abroad. Once I come back to US ,can i join with employer X on H1B and continue with GC processing?

    If above can't be done

    2. Assuming I withdraw my 485,so i will on H1B status. If H1B applicant currently working with company X in US and work for other employer Y for 1 year in abroad. Once I come back to US ,can i join with employer X on H1B and later continue with GC processing? - or H1B status abandon as soon as i change employment in Abroad

    Good question. I'm not sure if the two-year home residency requirement applies to tourist visas.

    But if your J-1 program isn't subject to the two year residency requirement, I don't see why there would be a problem.

    It is a travesty that the fates of some 35 million Americans who need food aid are tied to the farm bill, which comes up every five years. The House passed an inadequate version last summer, and the Senate has failed to advance its own. It is time to ask why feeding the hungry must include a trough for multibillion-dollar agribusiness.

    As it has pressed to keep its subsidies, about $26 billion in the current bill, agribusiness has contributed $415 million to federal political campaigns since 1990, according to the Center for Responsive Politics. The hungry don’t have much of a lobby. But those who cannot consistently put food on the table need the help promised in the bill, including more than $4 billion in improvements in the food stamp program and for emergency assistance. If the aid remains in the farm bill, and if it remains in a logjam, aid would continue at current, inadequate levels.

    Food stamps regularly help 26 million people get something to eat. But the previous farm bill did not peg benefits to inflation, so as food prices have skyrocketed, families who were just barely getting by are now in a much worse place. Some 800,000 food stamp recipients — disproportionately elderly or disabled — are being told to make due on a minimum benefit of $10 per month. That amount has remained unchanged in 30 years.

    As The Times recently reported, food banks and soup kitchens across the nation are being depleted by demand so overwhelming that the needy are being turned away, or given help so minimal, it is hardly worth the energy expended to get it.

    Washington needs to do better. The Senate could start by rallying around the sensible legislation sponsored by Senators Frank Lautenberg, Democrat of New Jersey, and Richard Lugar, Republican of Indiana. It would replace crop supports with an insurance program to cover actual losses, and put the savings, potentially billions of dollars, to better use, including for food aid.

    Or the Congress could make a bold statement and begin to restructure funding. It could get money to food banks faster if it came out of any bill but the farm bill.

    The Bush administration has correctly opposed the excesses of the farm subsidies program, but it could do more. It could finance additional and immediate food assistance by dipping deeper into money culled from customs receipts to support farm and nutrition programs.

    Since their beginnings, hunger relief and nutrition programs have been inextricably tied to helping farmers. That may have made sense once. But as recent maneuvers on the farm bill have shown, it no longer works.

    Republicans — by far the biggest beneficiaries of agribusiness largess — are using the advantage of being a bare minority to try to attach a flurry of amendments on immigration, taxes and any other issue but the desperate one at hand. Farm state senators look the other way so a bill, warts and all, can get done.

    They need to put America’s hungry first.

    We have filed for our I-485 application.
    I came to know from one of my friends that we do not receive our EAD after 90 days of receiving the receipt no
    we can go to nearest immigration office to get it.
    Is this the right span of time or we need to wait for more time.
    How does this work.

    1. You can start a business. But you can't work or spend time on it. Just spend money and some one can run it. Silent owner.
    2. Same applicable for H4.

    If you have EAD, H1 & H4 can work in your own business and work in current H1.

    H1 & H4 (without EAD) forget about starting business and sit in your own company/shop/gas station etc.... & MAKE MONEY. This is the fact.

    Question: Can person A on an H1B start own business while continuing to work with current H1B job? Can the business be not related to ones profession? Can a person on H4 visa start his won business too? Any answer is appreciated!

Dianne Feinstein (D-Calif.) went to the Senate floor to call for unanimous consent on a common-sense bill that would require candidates to file their campaign finance reports electronically. And just as he or she did on April 17, Sen. Ima Luddite (R-Who Knows Where) voiced opposition. This time the mouthpiece was Sen. Jim Bunning (R-Ky.). "On behalf of the Republican side," he said, "I object." We object to the obstruction.

    Honestly, what is the big deal here? Filing campaign finance reports electronically has been standard operating procedure for candidates for the House of Representatives and the White House for years -- as it has been for political parties, political action committees and "527" groups. Yet Senate candidates are still trudging down to the Senate Office of Public Records with paper copies of their reports, which are then passed along to the Federal Election Commission, which sends them to a vendor that punches in the information and zaps it back to the FEC electronically. That finally makes them widely available, sometimes too late for voters to see who's donating to whom and how the money is being spent. With this seeming fear of modernity, it's a wonder the Senate isn't calculating budgets with an abacus. Or is it a fear of disclosure?

    After the bill was blocked, Ms. Feinstein, chairman of the Senate Rules and Administration Committee, said, "It is very hard for me to understand who could oppose this and what their reason for opposing it could be." It is very hard for us, too. Sen.     Sen. Anonymous struck again yesterday.

    The infamous unnamed senator (or senators) has for more than a week blocked passage of legislation that would require Senate candidates to file campaign finance reports electronically.

    Electronic filings would make the names of campaign donors readily available -- it's how members of the House and presidential candidates have been doing it for years. When Sen. Russell Feingold (D-Wis.) first brought the bill to the floor last week, though, he was told that an unnamed lawmaker objected.

    Long-standing Senate custom allows the objection of a single senator to stop a bill in its tracks -- it's known as a secret hold. A measure that passed the Senate earlier this year, and awaits a House vote, would eliminate the practice.

    The hold unleashed a torrent of activity on the Internet, as bloggers tried to flush out the identity of the senator responsible for the hold. But after an onslaught of phone calls to Senate offices, the bloggers have no answer. No one owned up to being the culprit.

    Yesterday, the bill's sponsor tried again. And again, the Republican floor leader objected. A spokesman for Senate Minority Leader Mitch McConnell (R-Ky.) said he is sure the name of the secret senator is known "in the cloakroom," but he said that misses the point.

    "A hold can't stop something from coming to the floor," Don Stewart said. "It can only stop it from being pushed through without a full and open debate on the bill."

    That's true -- sponsors had been trying to pass the bill by unanimous consent, which does not permit amendment or debate. But Feingold told the liberal blog Daily Kos that the path was typical for a bill with 35 bipartisan co-sponsors that did not elicit a single objection in committee.

    Writing on the blog yesterday, Feingold said: "The fact is that someone anonymously blocked the bill, . . . that person has made no effort to resolve his or her concerns with us, and the Republican leadership won't even tell us who that person is."

    We have become political hypochondriacs. We seem eager to declare that "the system" has come down with some dread disease, to proclaim that an ideological "center" blessed by the heavens no longer exists, and woe unto us. An imperfect immigration bill is pulled from the Senate floor, and you'd think the Capitol dome had caved in.

    It's all nonsense, but it is not harmless nonsense. The tendency to blame the system is a convenient way of leaving no one accountable. Those who offer this argument can sound sage without having to grapple with the specifics of any piece of legislation. There is the unspoken assumption that wisdom always lies in the political middle, no matter how unsavory the recipe served up by a given group of self-proclaimed centrists might be.

    And when Republicans and Democrats are battling each other with particular ferocity, there is always a call for the appearance of an above-the-battle savior who will seize the presidency as an independent. This messiah, it is said, will transcend such "petty" concerns as philosophy or ideology.

    Finally, those who attack the system don't actually want to change it much. For example, there's a very good case for abolishing the U.S. Senate. It often distorts the popular will since senators representing 18 percent of the population can cast a majority of the Senate's votes. And as Sen. John McCain said over the weekend, "The Senate works in a way that relatively small numbers can block legislation."

    But many of the system-blamers in fact love Senate rules that, in principle, push senators toward the middle in seeking solutions. So they actually like the system more than they let on.

    As it happens, I wish the immigration bill's supporters had gotten it through -- not because I think this is great legislation but because some bill has to get out of the Senate so real discussions on a final proposal can begin.

    Notice how tepid that paragraph is. The truth is that most supporters of this bill find a lot of things in it they don't like. The guest-worker program, in particular, strikes me as terribly flawed. The bill's opponents, on the other hand, absolutely hate it because they see it as an effective amnesty for 12 million illegal immigrants. And, boy, did those opponents mobilize. In well-functioning democracies, mobilized minorities often defeat unenthusiastic majorities.

    And some "centrist" compromises are more coherent and politically salable than others. Neither side on the immigration issue has the popular support to get exactly what it wants. So a bill aimed at creating a path to citizenship for illegal immigrants is full of grudging concessions to the anti-immigration side. These have the effect of demobilizing the very groups that support the underlying principles of this bill. That's not a system problem. It just happens that immigration is a hard issue that arouses real passion.

    Typically, advocates of the system-breakdown theory move quickly from immigration to the failure of President Bush's Social Security proposals. Why, they ask, can't the system "fix" entitlements?

    The simple truth is that a majority of Americans (I'm one of them) came to oppose Bush's privatization ideas. That reflected both a principled stand and a practical judgment. From our perspective, a proposal to cut benefits and create private accounts was radical, not centrist.

    An authentically "centrist" solution to this problem would involve some modest benefit cuts and some modest tax increases. It will happen someday. But for now, conservatives don't want to support any tax increases. I think the conservatives are wrong, and they'd argue that they're principled. What we have here is a political disagreement, not a system problem. We have these things called elections to settle political disagreements.

    Is Washington a mess? In many ways it is. The simplest explanation has to do with some bad choices made by President Bush. He started a misguided war that is now sapping his influence; he has treated Democrats as if they were infected with tuberculosis and Republicans in Congress as if they were his valets. No wonder he's having trouble pushing through a bill whose main opponents are his own ideological allies.

    Maybe you would place blame elsewhere. But please identify some real people or real political forces and not just some faceless entity that you call the system. Please be specific, bearing in mind that when hypochondriacs misdiagnose vague ailments they don't have, they often miss the real ones.

    As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.

    The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

    Hi all,

    My I-140 was approved 2.5 years back and I-485 was also approved more than an year back.

    But, today the status on my I-140 got changed to "REQUEST FOR INITIAL EVIDENCE SENT, CASE PLACED ON HOLD". I am not sure, why did they reopen the case again. I checked with my company and they assured me that they didn't revoke my I-140.

    Could anyone suggest me what's happening to my case. Has anyone seen an similar kind of an issue and wat shd I do further ?
