I am planning drive to Halifax or Quebec end of this month.
I am intended to use �AUTO VISA Revalidation� rule.
I am from India and I don�t have any U.S. degree.

Hi,

I am on L1B with I94 expiring on April 2012 from Company X, I found an employer Company Y who will file my H1B in June/July 2011 under premium processing. If H1B is approved then:
1. Can I work under Company X till Sep end and join Company Y from 1st Oct without any hassel?
2. Will my status will change automatically from L1 to H1 from Oct 1st onwards?
3. Will my new H1b will be valid until April 2012 only? as my current i94 (on L1B) is till April 2012?
4. I can travel to India and return in Sep 2011 using my existing L1B? Will there be any problem in port of entry? I have traveled using L1B to-from India multiple times, but I am concerned now because I will be having H1b approved along with L1B.
5. Is there anything special I have to ask the employer before filing H1b so I can go and return from India on my L1b status?

Will appreciate response.

My I-140 on EB3 category is under appeal and decision may come in Aug 2011. I applied for Labor in EB2 category in Nov.2010 but it went for audit. This audit decision might come after 20 months. If my I-140 of EB3 is denied then can I extend my H1B status based on pending Labor Audit. My current H1B is valid till Feb 2012.

Please advice.

Last month dates were 7 Jan 2005.
This month dates are 22 Jan 2005.
Still the reported Jan 2005 approvals(, IV ) etc are less than 5.
Not sure whats happening to these

My sister filed 1-130 for me in 1997. I am currently living in the US on an H1B visa and the I-130 has been approved. As requested by the NVC, my sister submitted her affidavit of support (I-864) and paid the immigrant visa fee. However, I recently found out that I should have filed I-485 instead. I was advised that I cannot file the DS-230 because I live in the US. Is this true? Which could/should I do, DS-230 or I-485? Is there a way to get the immigrant visa fee returned?

I will appreciate any advice.

In above link, how is it possible to have pending I-485 (EB2) for 2008 & 2009 for India? If i remember correctly the priority date for India has reached upto Jul 2007 only so far.
