I would appreciate some feedback on following situation;
1) My wife is on H4/EAD. She is beneficiary of my AOS application. She holds Master's Degree from US. What is the best option for her to work on?
2) She was on H1B from Oct 2001 to Mar 2003. She COS to H4 after her job terminated with-in weeks. Since then she's been in US (on H4) and never been out for more than couple of months. Can she apply for H1B and not limited to H1B quota and wait till Oct?
3) Would changing to H1B abondon her AOS?
4) Can she work on EAD now and switch to H1B around Oct time if she has to apply for fresh H1B for next yr quota.
4) If she can get H1B, can she still use AP for travel?
6) If i loose job or my 485 is denied, isn't it better she has H1B so i can get on H4 or on her GC application.

I have a simple question. The total number of I-485s pending as per USCIS is around 220,000. If we have 130000 EB visas every year, will the backlog be cleared in just 2 years?

Labor clearance done March 2005; I140 approved 11/11/2007. Filed for I485 08/23/2007.
I am changing my title but staying with the same compnay. I am also changing location. few qs
1. Should I file AC21 due to location change?
2. can i file a new LC for the new job title (Its very very different than what what i did earlier) and carry my PD?

My I 140 approved under Eb3 if i want to change my job and my employer is willing to do in EB2 can I use my old PD from I140 EB3 ?

Can someone get GC’s without reaching the priority dates?
I don’t have much information but I heard the following by mouth. My friend told me that he came to know a person(Indian) who had got his GC without the priority date being current. His prior status was EAD. If it is real, is this a fluke case?
I know many people applied for I485 in 2005 Sep, and PD was also from that year, and got the EAD’s. So do they have priority of getting GC than people who had PD dates prior to 2005 but not filed for I485?

Well this is a peculiar case:
My OPT started may 15 06. I started working for my present employer from July 06 and we missed out on last years qouta and I was sure that they will apply for this years. Today my manager calls me up and says that we CANT. Now I am in a soup. May 15 -- Oct 1 break and on top of that I need to find a consultant who can sponsor me visa at this time. These are my questions:
1. I can get my general qouta H1 done by a consultant. So if I goto India, will there be any problems while stamping ??
2. Whats wise?? staying here, getting a new I-20 or going back to India ?? Because 4.5 months is a long time and I dont think I can afford the expenses here.

I am currently in L1B status and filed for AOS (I-140/I-485) in July 2007. My I-140 was approved last week and 180 days of pending I-485 are also over. My question is whether there is a huge risk involved in porting to a new employer using EAD, particularly because I do not have any other safety net like H1-B status. I understand, in case of I-485 denial, I will not have any other option to fall back upon. But if USCIS mistakenly issues a NOID or denial for some strange reason, would I have any other option to appeal without going out of country. Can I continue appealing such a potential denial from outside of USA and come if they reopen the case.
More specifically, I have heard some of the AC21 cases have been mistakenly denied or a NOID issues due to ignorant USCIS immigration officer. Can something be done to revive the AOS when there is no backup option like H1B? Would that action needs to be continued from outside of USA or can be done here itself.

The normal process I heard is that they start at the 70 day to complete it by the 90th day. So you can expect it from 70th day onwards.

Hi ,
I have been residing in the U.S. (NY) since 0ct 2007 with an H4 visa. My dad had and still has an H1B visa. I have completed my high school here in the States only and now I am enrolled as a full time student in a college (in-state tuition). Now the problem is I will turn 21 this February and I believe I will no longer be a dependent on my father's H1 visa and would be residing "illegally". In that case what should I do? I want to complete my studies and stay here in the U.S. with my family and not be deported back to my home country all alone :(
Is changing to F1 a good option for me ? I heard it could be risky? Is there any way I could have my studies going smoothly as it is now considering the out state tution under F1 would be too much...
any suggestions and help would be greatly apppreciated

I am a GC holder right now and would like know, if I should wait to become Citizen or file GC for my sibling now.
