    Company A had applied for an RIR Labor app in Oct'2002. In Mar'06 we got a letter saying that case was closed. Then the attorney asked it to be reopened and it was reopened. Then now end of Aug we got the approval.
    Im in my 8yr of extension based on this RIR.



    Ok since then in early 2004 Company B bought Company A. Then in Mid 2004 Company C bought Company B. Attorney at that time said i dont need to file any H1 and can stay in the H1 from Company A because it was a successor of interest !
    but now the attorney is saying that it will be very difficult to prove this is a successor in interest and there is no way we cna get the I140 approved.

    So..

    1. What do you guys think ? Has anyone gone thru' something like this. Any ideas ? I have also applied for PERM with the current company.

    2. How long can I continue without filing I140 for the labor that was approved.

    First of all I am filing by postal mail USPS(not e-filing)

    1)is it necessary to include I-765 receipt notice(EAD) with my AP application.. But I have only my last years one which will expire in a few months.
    2) for AP renewal is it necessary to include marriage certificate for spouse
    3) When filing by postal mail, and also considering i applied my I-485/I-140 before july 30/2007, old fee schedule... do i need to pay biometric fee for my AP renewal
    4) I am in Texas and for mailing EAD and AP - can I send them together for me and my spouse. I see different PO Boxes for EAD and AP addresses for the Mesquite, TX address

    IN I-765, is it enough only to specify the previous EAD information regarding the office filed and receipt date...or do i have to include my OPT EAD as well as my previous EAD filed last year.


    Any clarification is highly appreciated

    My law firm applied my EAD/AP/485 on Aug 13th. I got my Receipt Notices for all three.
    My question is where does USCIS send the FP Notice and EAD?
    Do they send it to my house address or lawyer?

    Just asking out of curiosity because when an illegal alien lives and possibly runs from cops from place to place for a period of time then they are qualifed for a green card and eventually citizenship.

    My sister's H1B petition was approved on 2008 and she was unable to travel US for the past 1.5 year.

    She is working in a MNC company in India. Now, she came to US on her B1 visa 1.5 month back. Meanwhile, she got an offer from a client in US and she want takeover the new job on her approved H1.

    So, can you please let me know whether the employer (whoever filed my sister's h1) can file the H1B amenment while she in US with B1 visa and having H1B approved petition? If so, how many days she has to wait to get the approved amenment to start her work at client place? The employer is going to do the premium payment so that can we assume the amenment will be approved for sure?.

    The LCA is really required for H1amenment? Please advice. This is really urgent.

    I received RFE letter from USCIS for missing TB skin test result in the medical reports.I took TB skin test in 2007 and came out negative.Here is the test of RFE

    "your application contained form I-693 in which the required TB skin test was not conducted. Please note there may be conflicting information on some published form I-693 instructions regarding when the chest X ray Report should be performed. It is required only when the TB skin test indicates a reaction equal to greater than 5 mm, or when the reason for why the TB skin test is medically inappropriate to perform has been annotated on theform I-693. Please submit a newly completed form I-693 indicating the results of the required skin test."

    After consulting the doctor concerned, she filled up new I-693 form with 2007 test results and provide me I-69e form in a sealed envelop. Can you please let me know whether 2007 TB skin test results will be acceptible to USCIS or do I need to do another TB skin test? Please Help.

    Hi

    Now that the EB2 dates have moved forward till Dec 2003, how many of us expect our approvals in the coming months ? Would the bulletin move forward in coming months or would go back or may be become unavailable again ? Any thoughts ?

    I hope the same forward movement happens for all EB3 applicants too.

    How does one now expedite thier case if they are current ? Just by 1-800 .... calling or Infopass ?

    Congresswoman Zoe Logfren & & senator John Cornyn are supporters of legal immigration, they have always come forward to help the legal immigrant community. I guess it is high time people from California & Texas write & call to their offices and complaint about USCIS/DOS action of not releazing and statistics on I-485 applications pending invarious categories. We are blind folded by these Visa bulletins with no idea of what there for EB-3, EB-2 India, China etc. we don't know how many people are ahead of us what to do next. All this will resolve it USCIS/DOS tells us how many applications they have pending from which country and which category....For that we need to call these lawmakers..

    One of my friends has been unemployed for the last 6 months but his AP and EAD are current. He needs to go to India in June. Will he face any problems while coming back into the country? Should he postpone his India trip till he he has been on a job for 3-4 months? If he starts his own company and gets a salary from that will it cause problems? Also Newark is his closest airport. Is Newark OK for AP or should he try Philadelphia or JFK in New York?

    DeMint's Tactics Irk GOP Leaders (http://www.rollcall.com/issues/53_7/news/19395-1.html) By John Stanton and Erin P. Billings, ROLL CALL STAFF, July 17, 2007

    Sen. Jim DeMint's (R-S.C.) speedy ascension to de facto leader of the Senate's conservatives may have won him a number of fans among fiscal hawks, reform-minded watchdogs and some fellow Republican Senators, who applaud the first-term Senator for his willingness to buck the chamber's "Old Boy" traditions. But DeMint's tactics have started to chafe GOP leaders and prompted private warnings that their tolerance has worn thin.

    DeMint led a small group of Republican conservatives who successfully killed immigration reform in June and has openly dueled with Democratic leaders over earmark reform, calling them out for refusing to adopt Senate-specific earmark rule changes before going to conference on a broader ethics bill that includes them.

    That willingness to sidestep his leadership on immigration last month, and his ongoing fight with Majority Leader Harry Reid (D-Nev.) over earmarks reforms, has begun to irritate Republican Senate elders, including Minority Leader Mitch McConnell (Ky.) and Minority Whip Trent Lott (Miss.).

    According to several Republicans, party leaders have made it clear to DeMint that while they may give him some running room over the next few appropriations-laden weeks, they will not tolerate what they see as repeated efforts to hijack the Senate floor and the public spotlight.

    DeMint declined to comment directly on any warning leadership may have delivered to him regarding his increasingly high-profile crusades. But he did say it is up to McConnell and other GOP leaders to take up the mantle of reform if they do not want others to do so.

    "I have a lot of respect for our leadership, and we work well as a team," DeMint said. "But there are enough of us who believe this is where we need to go as a party. And we hope our leadership will take us there. But we'll take up the banner if we need to."

    Publicly, many Senate Republicans applauded DeMint's courage to take on the normally decorous chamber and for sticking up for conservative principles at a time when the party is struggling to regain its footing. But several Senators and high-level aides also privately noted that DeMint needs to be careful not to go too far, with several saying he runs the risk of being marginalized as he carves out a reputation of a flame-throwing, first-term Senator who casts aside legislating altogether.

    "You have to always be careful around here not to overplay your hand," Lott warned last week.

    Although disagreements between the two date back to DeMint's opposition to a Lott proposal to move train tracks in his state following Hurricane Katrina, the two have had an ugly split in recent weeks over DeMint's role as Republican Steering Committee chairman. According to GOP aides, Lott yanked his annual $7,500 contribution to the committee's funding after DeMint aides criticized his efforts to push through the failed immigration reform bill. Lott's move to pull the funds was first reported in Congressional Quarterly.

    "At some point [DeMint is] going to have to learn he can't always throw missiles," said one senior Republican aide. "He's going to have to work on diplomacy. But so far he's been rewarded for his behavior and has yet to pay a price for it."

    With that in mind, Republican sources said GOP leaders are keeping a close eye on the South Carolinian as he continues his crusades. Those GOP sources said conversations between the leadership and DeMint have taken place, and the message has been made clear that McConnell's patience isn't limitless when it comes to DeMint's efforts to block legislation or shut down the chamber to push his priorities.

    So far, however, most of DeMint's colleagues - especially those in conservative corners - seem to be accepting of his procedural maneuvers.

    "My own view is it's every Senator's right to protect their interests," said Sen. Judd Gregg (R-N.H.). "He was very effective on the immigration bill, and a lot of his colleagues were with him."

    And while Gregg acknowledged DeMint carries less favor with Senators over his current cause to use the ethics package as the vehicle for his opposition to earmark spending, he believes DeMint's standing in the Conference remains intact.

    "Everyone is very individualistic around here," Gregg said. "You don't run the risk of losing the respect of your colleagues just for being individualistic. It's just the opposite."

    But not all Senators view it that way, especially among veteran Republicans who cherish a chamber that's known for putting a premium on decorum, deliberation and seniority. DeMint, in contrast, was part of the more aggressive band of Republicans elected in 1994, some of whom have since moved from the more partisan House to the Senate.

    Sen. John Ensign (Nev.), who as chairman of the National Republican Senatorial Committee is in the leadership circle, said the reviews of DeMint's tactics "depends on what side you are on."

    For Ensign, that's on the side of DeMint and others who he called "a breath of fresh air in the U.S. Senate." Still, Ensign conceded that the approach isn't without flaw, saying: "There's always a risk, there's always a balance. But when you are in the minority, you need to exercise your rights."

    Indeed, DeMint has a loyal following among more junior Republicans, particularly his fellow House alumni, and those Senators who believe it behooves the party to fight rather than negotiate with the now-majority Democrats.

    "It's a thankless task," said Sen. Jeff Sessions (R-Ala.), who joined DeMint in his efforts to defeat the immigration reform measure.

    "Some people get mad at him, they want him slowed down," Sessions said. "But right now, most Republicans respect what he's doing. Really, my impression is that even those who are dubious of DeMint's leadership are beginning to feel like this is healthy and that maybe we do need a more vigorous debate."

    DeMint said while some senior Republicans such as Sen. Kit Bond (Mo.) have supported him, he acknowledged that much of his backing has come from the GOP's increasing ranks of junior lawmakers.

    "It's not universally true, but to a point it's true. It's one of the unfortunate things that has happened to Congress over the years," DeMint said, adding that many lawmakers are afraid to speak out because they are afraid of reprisals.

    "A lot of people are afraid if they come out strong against earmarks they're not going to get any," DeMint noted.

    As for the chamber's more entrenched Members, DeMint argues that their opposition - both public and private - is motivated by their desire to keep cash flowing to their states. "A lot of their power and clout back home is based on how much money they can bring home," he argued.

    DeMint said his party would be wise to take up the issue of ethics as a central fight, arguing that in recent weeks he has seen increasing interest across the country in his battle with Reid. "In some ways this is immigration all over again in that out in the public there's a feeling that this is wasteful spending" and that Congress is failing to seriously address the issue, he said.

    DeMint also has begun to reach out to the vast network of editorialists and talk radio hosts that backed his successful rebellion against the immigration debate and has been credited with giving DeMint and his supporters enough public support to defeat the bill.

    Significantly, he also has begun to see support from other media outlets, which are not normally connected to the conservative world. For instance, the Los Angeles Times editorial board has come out in support of his work, DeMint noted, and he believes that people across the country are becoming increasingly upset with Congress' handling of earmark reform.

    DeMint - who calls the earmark process "one of the corrupting [forces] of Washington" - said McConnell has so far backed his efforts to force Reid to accept the Senate rule changes before conference to ensure no changes to the earmark reforms are made. "Mitch McConnell is very supportive of what I've been doing," DeMint said, adding that "he's asked me to work with Sen. Reid" to find a solution.

    But Reid "has been stonewalling me," DeMint said, and seemed skeptical that any solution appears imminent.

    DeMint also said that regardless of his leadership's complaints or demands - or those of the Senate's old guard - he will not back down. "This isn't a job I wanted, but I'm good at it," he said, adding, "I'm going to continue doing what I'm doing."

    I am an American citizen. My Chinese wife of 3 years and I will move to St. Louis and buy a home there. She is a businesswoman and must return to China several times per year to take care of a business there. She will be applying for her immigrant visa very soon.

    HOW MANY DAYS PER YEAR CAN SHE LEAVE THE US PER YEAR WITHOUT PUTTING HER IMMIGRANT VISA IN JEOPARDY?

    Being a US resident is more important that the job, but we would like to do both, if possible.

    I apprecite ANY advice formn knowledgeable people, including non-lawyers.

    Interim EAD's are no longer an option since Sep 2006

    In case of emergency travel it is possible to get AP from local office

    But in case of extreme emergency like death in the family, funeral etc

    I am working for a client which gave me an offer for a respectable amount. it is much higher than the amount specified in ETA 9089 (F/5) column. my Onet code for the original labor is 15-1071.00. my new job is defined as System Specialist. my job functions( roles) are pretty much the same as my original labor certificate. I tried to search the Onet Code for System specialist and did not find a good match.
    Can any one suggest me what are the options.

    I also wanted to know weather USCIS will send any letter to new employer regarding to the offer extended to me. MY situation is the client is not willing to sponsor me.

    I have a question on visitor visa, please tell me is this legally okay or not
    My parents got vistor visa (B1/B2) and planning to visit me,
    my sister also got a visitor visa (B1/B2) through a company some time back. But she never visited US and later moved to another company.
    All are 10 years multiple entry visas.

    Is it okay that sister comes along with my parents? Is there a difference between company applied visitor visa and visitor visa that I sponsered.

    As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.

    The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

    hi,

    I am planning to extend the visitor visa for my mom for another two months.
    Her current I94 expires on June 25th and At POE the officer told her that she must go back after 6 months

    If I apply for extension of her visa before 45 days and she leaves US on current I94 date (June 25th) since she did not get a result,
    1.Does she need to apply for a new visa since her extension got rejected even though she left before her current I94 date?Will it affect her future visits in case that extension gets rejected.?

    2.What happens if she gets a rejection before her current I94 expiry on July 25th, will she need leave earlier and apply for new visitor visa?

    FOUR MONTHS into the 110th Congress is too early to assign grades to the new Democratic majority -- but not too soon to remind lawmakers that most of their self-assigned tasks remain undone; that progress in the next few months on immigration, trade and lobbying reform is critical; and that this Congress will be judged on what it accomplished -- and on where it punted.

    The biggest punt thus far concerns entitlement spending, an issue on which the administration, chiefly Treasury Secretary Henry M. Paulson Jr., has been seeking to jump-start discussions. This is an auspicious moment that Democrats seem determined to squander. First, the Democratic Congress has a lame-duck Republican president who could take, or at least share, the blame for cuts that will have to be part of any solution. Second, as members of Congress well know, the longer they wait to take on Medicare and, particularly, Social Security, the harder the problem they will face.

    Democrats have seized on Vice President Cheney's comments to Fox News in January about raising payroll taxes -- "This president has been very, very clear on his position on taxes, and nothing's changed" -- as a rationale for why they can't risk bargaining with the administration. But this is an excuse, not a legitimate basis for inaction. After all, Mr. Cheney also said there would be "no preconditions."

    Meanwhile, lawmakers for the most part have used their oversight powers usefully, though we wish more energy were spent examining torture policies, for instance, and less on subpoenaing the secretary of state. Although the budget process has yet to play itself out, the adoption of tough pay-as-you-go rules to constrain new mandatory spending has had a surprisingly beneficial effect in restraining demands for new programs. The Senate's passage of a measure to strengthen the Food and Drug Administration's regulatory powers is an important step.

    Still unanswered is whether Democrats will deliver on their campaign promises and whether both sides will find ways to forge consensus on issues of common concern. House Democrats' "Six for '06" campaign pledge has so far amounted to "None in '07." Much of this (federal funding for embryonic stem cell research, for instance) is out of Democrats' control, given the Senate's supermajority rules and President Bush's veto pen; in some cases (having Medicare negotiate drug prices, for example), that's just as well. But even such relatively noncontroversial matters as increasing the minimum wage remain undone. Voters are starting to notice, and the coming weeks will be crucial for Democrats to put some actual accomplishments on the board.

    On a matter that is within their control, it's still uncertain whether House Democrats will produce a lobbying and ethics reform package worthy of their campaign pledges to end the "culture of corruption." The key tests will be whether lawmakers require lobbyists to disclose the bundles of campaign cash they deliver (as the Senate version of the measure has done) and whether the House will create a more credible ethics process, including some kind of independent arm to assess and investigate ethics allegations.

    On immigration, Senate Majority Leader Harry M. Reid (D-Nev.) is right to bring to the floor last year's measure, which won the support of 23 Republicans. The clock is ticking on this incendiary topic, and the administration has not improved matters by pushing an unbalanced and punitive plan. If Mr. Bush is looking for a legacy issue beyond Iraq, this could be it, but he is, so far, blowing the chance.

    On trade, an agreement that seems to clear the way for approval of trade pacts with Peru and Panama is a start, but only that. Much more important is the passage of deals with Colombia and South Korea, and extension of presidential trade negotiating authority, which is needed to complete a new global trade treaty. Congressional leaders should work with Mr. Bush to extend the authority -- not because they like or trust him but because doing so will be better for the economy in which they, too, have an important stake.

    My spouse plans to start her Masters program on H4. I am told that she can, at anytime apply for Change of status to F-1. I am myself on H1b.

    1. I would like her to continue studies on H4 and change to F-1 via COS only if needed. i.e. as a back up option, in case I loose my H1 status via layoffs etc..). Is this possible?

    If her H4 to F-1 COS is filed, should my H1b remain valid till her COS to F-1 is approved? I am told COS can take several months. Thx.

    This is one of those odd weeks when Congress may actually work. Both houses are likely to pass Democratic bills to expand SCHIP, the children's health coverage program. Yesterday, the House enacted lobbying reform, and the Senate may follow suit tomorrow. Also yesterday, the House passed a bill restoring the right of victims of pay discrimination to sue their employers.

    In short, it's one of those weeks when Nancy Pelosi has no doubts about the wisdom of her decision to become speaker of the House.

    "What's it like?" she asked herself, beaming, at the conclusion of a breakfast meeting with roughly 20 liberal journalists yesterday morning.

    "It's fabulous! Absolutely fabulous!"

    It can't always be thus. Her biggest frustration, of course, is Congress's inability to end the war in Iraq, which she terms "a huge moral catastrophe for the country." It is the public's biggest frustration as well, she says, and the main reason that popular support for Congress has plummeted.

    In September, Iraq will once again be Congress's chief item of business, when Gen. David Petraeus delivers his state-of-the-war report.

    Pelosi (understandably, given the administration's mountain of misrepresentation on all war-related matters) is wary. "The plural of anecdote is not data," she said. "I'm very concerned they'll pass off anecdotal successes as progress in Iraq."

    The question in September will be whether congressional Republicans continue to support President Bush's open-ended commitment to keeping U.S. forces in Iraq while a civil war rages around them. To date, the Republicans' strategy, and not just on the war, has been to thwart the Democrats at every turn and to use the Senate's 60-vote supermajority requirement both to create a "do-nothing" Congress against which they can run and to spare their president from having to veto popular legislation. (Why they care about sparing Bush -- he will never face voters again; they will -- plunges us into the murk of abnormal psychology.)

    The GOP strategy is not without its pitfalls. Republicans have succeeded in tanking Congress's approval ratings, but polls consistently show the public, most importantly in swing districts, preferring Democrats to Republicans. With this week's vote on expanding SCHIP, though, Democrats are convinced that the price of blocking health care for uninsured children is more than many Republicans are willing to pay. Bush has vowed to veto the legislation; Pelosi, noting with an almost incredulous glee that the administration will stand athwart children's health care on the grounds of opposing a higher tobacco tax, says, simply, "Welcome to this discussion."

    Not all discussions, even in a good week, are so pleasurable to anticipate. Asked about the resolution that her congressional colleague Jay Inslee of Washington has introduced to impeach Attorney General Alberto Gonzales, Pelosi put her hands to her temples as if to ward off a headache. For the past year, Pelosi has made clear to her colleagues and the public alike that she has no interest in pursuing the impeachment option, though Gonzales is certainly doing his damnedest to change her mind. She remains unpersuaded, believing that impeachment would fail and in the process would make weeks such as this one -- a week in which the public's business is at last getting done -- far more uncommon than they already are.

    Pelosi understands the gravity of the damage that the administration has done to the Constitution and why that has impelled some of her colleagues to advocate impeachment. "If I were not the speaker and I were not in Congress," she said, very quietly, as she concluded her answer, "I would probably be advocating for impeachment." But the consequences she foresees from stopping the nation's business for an unwinnable fight outweighs those considerations.

    Pelosi deserves considerable credit for holding her party together on a range of divisive issues, but she plainly views the coming fight among House Democrats on fuel efficiency standards as irrepressible.

    The energy bill the House will pass this week contains no provisions that would raise those standards; such provisions, if any, await the outcome of a battle between Pelosi and Energy and Commerce Committee Chairman John Dingell, the Democrat who has represented Detroit and the auto industry in Congress since 1955 (that is, before tailfins).

    "I respect all our chairmen," Pelosi said. But the legislation, she continued, isn't about them. "It's about our children's ability to breathe clean air. Nothing less than the planet is at stake. I love him [Dingell] dearly, but we have to prevail. . . . The forces at work here [against stricter standards] are rich and entrenched," she concluded, "and it takes just a few [votes] to prevent us from unleashing the future."

    Thus, the most elegant of happy warriors, in a week when it's fun to be speaker.

    Nobody can predict when the quota will fill up. However, note that there are wide spread rumors about the regular quota being used up as early as the first day and Masters within a few weeks. Its in your best interest to file as early as possible.

    Here are the time lines for last year:

    Hi all,

    My PERM labour certification was filed on 25th oct 2006, my case was selected for random audit on dec 06. My attorney replied with all the evidence for the audit. After reviewing the case CO at dol denied my case on Feb 07.

    My attorney has asked my case to be reconsidered/reopen on March 2007 as they are confident that they have supplied all the documents required for the case. My attorney says it will take 6-8 months for DOL reopen the case and judicate the same which is Nov 07. what is best option i have as all the dates are current now? i have discussed with my attorney they have told me clearly they are not going to reapply as its a very big company and it will take lot of time for me to get clearance to file my perm again.

    Does anybody having experience like my case can share your views it will be really helpful.

    My H1-B visa ended on December 31, 2009. I applied for a change of status to F1 visa on December 21st, 2009 towards the Spring 2010 (Jan 2010) semester. I received an RFE stating that I need to send a new I-20 for a valid future semester.

    Assuming this new I-20 is for Summer 2010 (May 2010), my question is as follows - If my change of status to F1 gets approved and my semester starts 2 months later, am I allowed to legally stay in the country?

    The distinguishing characteristic of this Congress was on vivid display the other day when the House debated a bill to expand the federal program that provides health insurance for children of the working poor.

    Even when it is performing a useful service, this Congress manages to look ugly and mean-spirited. So much blood has been spilled, so much bile stockpiled on Capitol Hill, that no good deed goes untarnished.

    The State Children's Health Insurance Program (SCHIP) is a 10-year-old proven success. Originally a product of bipartisan consensus, passed by a Republican Congress and signed by President Bill Clinton, it was one of the last domestic achievements before Monica and impeachment fever seized control.

    It is up for renewal this year and suddenly has become a bone of contention. President Bush underfunded it in his budget; the $4.8 billion extra he proposed spending in the next five years would not finance insurance even for all those who are currently being served.

    But when the Senate Finance Committee proposed boosting the funding to $35 billion -- financed by a hefty hike in tobacco taxes -- Bush threatened a veto, and he raised the rhetorical stakes by claiming that the measure was a step toward "government health insurance."

    That was surprising news to Republican Sens. Chuck Grassley of Iowa and Orrin Hatch of Utah, two staunch conservatives who had joined in sponsoring the Senate bill, which the Senate Finance Committee supported 17 to 4.

    But rather than meet the president's unwise challenge with a strong bipartisan alternative, the House Democratic leadership decided to raise the partisan stakes even higher by bringing out a $50 billion bill that not only would expand SCHIP but would also curtail the private Medicare benefit delivery system that Bush favors.

    To add insult to injury, House Democratic leaders then took a leaf from the old Republican playbook and brought the swollen bill to the floor with minimal time for debate and denied Republicans any opportunity to offer amendments.

    The result was undisguised fury -- and some really ugly exchanges on the floor. The worst, given voice by former speaker Dennis Hastert, a Republican from Illinois, among others, was the charge that the Democrats were opening the program to illegal immigrants. The National Republican Congressional Committee distributed that distortion wholesale across the country in a flurry of news releases playing to the same kind of nativist prejudice that sank the immigration reform bill. In fact, governors of both parties support the certification system included in the bill for assuring that families meet citizenship requirements; the governors know that too many legal residents have been wrongly disqualified because they could not locate their birth certificates.

    In the end, the House bill passed on a near-party-line vote, 225 to 204, far short of the margin that would be needed to override the promised Bush veto. That means the program will probably have to be given a temporary renewal before the Sept. 30 deadline, and eventually Democrats and the White House will negotiate an agreement.

    So it will go down as one more example of unnecessary conflict. No rational human being could explain why a program that both parties support and both want to continue could ignite such a fight.

    But that is Washington in this era of polarized politics. As Congress heads out for its August recess, it has accomplished about as much as is usually the case at this stage. It passed an overdue increase in the minimum wage and an overdue but healthy package of ethics reforms. It moved some routine legislation.

    But what the public has seen and heard is mainly the ugly sound of partisan warfare. The Senate let a handful of dissident Republicans highjack the immigration bill. Its Democratic leadership marched up the hill and back down on repeated futile efforts to circumscribe American involvement in Iraq, then shamefully pulled back from a final vote when a constructive Republican alternative to the Bush policy was on offer.

    The less-than-vital issue of the firing of eight U.S. attorneys has occupied more time and attention than the threat of a terrorist enclave in Pakistan -- or the unchecked growth of long-term debts that could sink Medicare and Social Security.

    And when this Congress had an opportunity to take a relatively simple, incremental step to extend health insurance to a vulnerable group, the members managed to make a mess of it.

    It's no wonder the approval ratings of Congress are so dismal.

    Hello,

    I filed 485 and also obtained EAD and AP. My wife has her own H1b through her employer, but used the AP from my 485 application once to enter the U.S., so right now her I94 shows an �AOS� status without an expiration date. Now her employer just filed H1b extension for her and the case is still pending.

    My question is:
    1) Can she travel internationally while her H1b extension case is pending and come back using AP? I was told this could void her H1b extension application according to the �last action rule�, is that true?

    2) If 1) will be a problem, could it help if she stays aboard until her H1b extension gets approved and have the document mailed to her before she comes back?

    If it was filed in the EB2 category, it is likely that they picked the case for a random audit. EB2 labors do get audited during PERM processing to ensure that the case does meet eligibility requirements for EB2. There is no clear pattern to this auditing though, some cases get audited and some do not.
