HI,

I am in US and have changed a job recently (changed status from L1 to H1 while in US). I plan to travel to india soon in Feb 2010. My passport is valid till March 2011 and my H1b approval is till 2012. Will this be a problem for me when I go for stamping in India.

It will not be "a problem"; but they will stamp your passport only till the exp date of passport (March 2011) and your I 94 (that you will get upon returning) will also be valid till March 2011 as well.

Hi,
I have applied for COS from L1-B to L1-A and received an RFE which we have responded to.
The application is still pending with USCIS, while my I-94 is expiring on 07/31

What will happen if I do not receive decision before expiry of my I-94? Will I be out of status after the I-94 expiry date.
I have my I-485 pending as well (I-140 approved) and have EAD but not used.

Good morning and thank you for reading my message and considering my question

My attorney has filed an appeal with DOL regarding my prevailing wage, which my state workforce commission rejected (deeming it too low). We were told that we should expect a response from DOL in about 3 weeks, but it has now been close to 10 weeks and we have received no response yet. The attorney is checking with DOL weekly but there has been no response thus far. Is this normal? How long can I expect to wait for a response? Thank you very much in advance for any guidance!

I had received FP notice 2 days ago and my FP date is after 3 weeks. I was getting ready to try to do it early but I just received Card Production Ordered email for both my spouse and myself. What do I do now? Do I need to still go for the FP after 3 weeks.

Yes in Montreal, Canada on Aug 26th, 2009. All is well. I got my h1b visa renewed for 3 years. They had to do electronic followup since my LIN is not found in PIMS. But I got my passport, visa next day at 3pm.

Hi

My wife H1B was approved under Consular Processing. She got job offer now and it is a Consulting job to Hire. We applied COS at CSC by Premium processing. Reached application on Sep 28 and Status is Acceptance by then.

1 ) Everything is genuine and in the client letter it is mentioned as 6 Months contract to hire. Are there any posibbilities of getting H1B approved for only 6 months from now.

2 ) Are there any chances of rejection

3) Sincle past week it is under "Acceptance" stage. I know i have to be patient.

4) Can we expect some decision from them this week as client is waiting.

5) At what time CSC updates the case. Is there any particular time they update the case online.

The U.S. Citizenship and Immigration Service (USCIS) recently issued guidance on the new H-1B amendment that limits Troubled Asset Relief Program (TARP) recipients� ability to hire H-1B workers. The USCIS confirmed that the new H-1B amendment does not apply to H-1B extensions for current employees with the same employer.

hello, i really need some one to clarify this information for me.

when i first started working with my company i did not have work authorization and basically said i am a US citizen, i never had any problems for 4 years, i am a permanent residence now and got my green card this year. the company now nows that i lied 4 years ago when i got hired and i was not allowed to work but am fully eligible to work now becaue of change in status to PR. can the company resubmit a new i9 form with the correct information and if i will be in any trouble with USCIS.

What is the law for someone who worked illegaly but got his or her status changed to PR.

Hi,

I was working for Company A with whom I've my H1 & I-94 valid until Aug 2010. But I was laid off from Company A in Dec 1st week and I found a new job with Company B in Jan 3rd week. So I was out of status for about 6 weeks time.

Now Company B don't wish to file a transfer but instead they are filing something called H1 "Loose Petition", obviously I'm not going to start work with Company B until this H1 gets approved and I travel out of US, get restamped based on my New H1 petition, come back to US and start work for Company B.

But my question is, while from today until this so called "Loose Petition" H1 is getting processed (since they applied premium it would take about 2-3 weeks) can I legally stay in US (in terms of I-94 I've my I-94 from Company A H1 which is valid until Aug 2010)?

My employer suggest that I stay here until H1 processing result comes out and then leave country get restamped. Please let me know if you have an Answer.

We filed our 485s during the July 2007 fiasco. We moved after an year, so we updated USCIS with our new address by filling AR11 online for all the petitions(485s, 140)
My 485 status is in pending state but by husband's petition has a status of "Notice Returned as Undeliverable". Now it is more than 6 months since that update. Do I have to follow up on it? Any input appreciated. Thanks much in advance.

Hi- When I started off with the green card process, I had not idea about what most of the things meant. I joined a very reputable Fortune 500 company in 2006 (the same year I came to the US on a H1B), and started my GC process in 2007. The company offered me an pre-approved labor with a 2006 PD, which had a matching requirement w.r.t job description and salary.
During July 2007, i filed for my I-140 and I-485. Subsequently, my I-140 got approved without any issues. Now, given that my priority date is close to being current (2/14/2006), I'm afraid if using a pre-approved labor will have any role to play with my I-485 approval.

And no, I'm not working for a consultant. And I have been with the same employer since 2006.

Hi,

We filed a dependent I-485 for my wife while she is on a F1 status. She has a EAD card (but my I-140 is pending). My understanding is that once she finishes school, she will not be able to get an OPT. Does it mean that she can accept employment using the EAD even though the I-140 is not approved?

I have been in the US for a couple of years working on an E-1 Visa. I am now filing my I-765 because my Visa is tied to me working for a particular company and is not transferable. I have a social security card.

I am now not sure if I should fill this out as if I am applying for a or b:

A) Permission to accept employment
B) Replacement (of lost employment authorization document)
C) Renewal of my permission to accept employment (attach previous employment authorization document). Form I-76

If it is C, should I attach a copy of my E-1 Visa and my Social Security card or something else?

Also, for question 11 (Have you ever before applied for employment authorization from USCIS)? I don't think I have. I think my E-1 Visa came with this right and that I only dealt with the social security office.

Please help if you know the answer

I-485 petition will be undated automatically as soon as the corresponding I-140 is approved.

As far as I know, you don't have to inform uscis about your I-140 approval.

Many of us have had a positive reaction to the TB skin test. So we take an X-ray to confirm we are fine and the doctor mark normal in the chest X-ray section. Pretty routinely done.

Now my spouse had a negative TB skin test, so no X-ray needed. However the physician and my attorney have different views on how to fill out the chest X-ray section of the form. The physician checked nothing in the section and is very adamant about the way he fills out the form. My attorney believes that the NOT DONE box in the section should be checked as he claims that he has seen REFs if the NOT DONE box is not checked. What is your opinion? Appreciate your feedback. H-1B employers need to be aware that June 30, 2009 will be the last day that the Department of Labor�s LCA Online system will be operational. As of July 1, 2009, all LCAs for H-1B and E-3 cases will need to be submitted through the iCERT portal (http://icert.doleta.gov/) and that means the end of instant LCA certifications.

This has very important implications for the timing of H-1B and E-3 applications as they relate to new hires and extensions. Employers will need to allow for delays in LCA certifications of at least 7 days rather than the instant certifications that were previously issued.

hi gurus, a question.

I am currently out of US but working for same company in Europe

I have approved 140, but waiting for PD to be current - (Jan/03, EB3-I).

I am now a sr manager and seem to be eligible for EB1C (if company agrees).

Option 1)
- continue to stay in Europe and apply for 140 (eb1c)+CP
- while waiting for 140 approval, am i eligible for: EAD and AC21 (after 180 days)

Option 2)
-move to US on L1 visa and apply for 140 (eb1c) + 485

Option 3)
- wait for PD for eb3 application to be current

My I485 application was received at the Texas center on Nov 6th. No receipts yet and checks have not cashed, although the USCIS website says it is current for receipts. Anyone in my situation?

Today I got an SLUD on my pending 485 after almost more than a year. Last one was from July, 2008 (address change). Don't understand what exactly is going on. For RFEs are there usually SLUDs before? or just an hard LUD with message change? Anyone in same boat? :confused:
