May of you may be familiar with Professor Vivek Wadhwa from his columns in BusinessWeek and his major papers published on skilled worker immigration. I got to meet Professor Wadhwa when we both spoke at an ImmigrationWorksUSA conference a few months back. He gave a very informative presentation using the slides I'm attaching. My H1B was refused under section 221(g) (petitioner is not able or willing to provide employment....) and case has reached USCIS for review. The lawyers however are asking me to travel on H4 and then convert to H1 in US and they say this can be done in 2 weeks. I am so very skeptical about this! How is this even possible?
Their response is that i have an H1B from earlier quota, so i can get a new petition filed and start working on it once its approved.How come people dont do this if its valid?
My questions if anybody can help me are
1) Can i go on H4 visa without revoking my H1B petition which is under review with USCIS? Or will consulate ask me to revoke my H1B petition?
2) If i go on H4, can i really get a COS to H1 in US i.e. not the April 2011 quota but in the already assigned quota and i can start working within a few days of approval?

Trying to get my green card (11 Years in the waiting) .
My I-140 was denied / and we have applied for Motion to Reopen . in the meantime, i have my AP approved this 2011. can i switch employer.

started as an intern with local in the month of march 06 and I was given offer till end of august. but my school official gave me work permit on a semester basis and gave it only for srping 06, which end in may 15th. I couldn't update my CPT status for 1 day for summer 06 and started on 16th may, so the school official has said that i am out of status.Since re-instatement is not possible from school as it was unauthorized work permit. They have advised me to go to home country and attend visa to be eligible for reinstatement. I have grauduated last month with masters of science..
They said they will provide me recommendation letter for me to show to consular officer. Also, I have an MBA admit in same university for spring 2007.
so should i come to new program..if thats the case how to get an emergency appoitment.

Hi there,
I have this question.
I have got the green card along with some of my family members except my older child who was 21 at the time of my I-140 application.
I filled out an I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN last December and it was approved last month.
I am a bit confused as on the approval notice it is said that in 90 days National Visa Center is going to send the beneficiary a set of instructions. Calling NVC myself I was told that they are not going to sent anything, it is supposed to wait for a visa number to become available and they are working now on visa cases from 2002!
Does anybody has an idea how this is working and how long it will take to get a "visa number" and a green card? Is the origin country (Romania) of any significance in terms of time?

I applied for I485 like many others in July. I just heard my group may be spun off from its parent company and might be funded by VCs. Does this mean I cannot use my LC/I140? If/When I get my EAD will it be valid?

Hi, this might not be the right forum for my question but at least I am hoping that I can either can an answer or steered to the correct direction. So I quit my job in the US about a month ago because I was immigrating to another country. My job was located in Arizona and I immigrated to Israel. My company knew this was the reason I was quitting. So I am wondering if I should have received a severance package or unemployment benefits because of the reason of immigrating to another country.

i have H1B with Company A and it is valid till next year but i moved to Company B past two years back i worked with them now no job he said he is terminating h1b, so can i stay with previous company A (once i get the job i can switch to him until then can i stay with there h1b or not) or i will be in illegal status plase help me out.:confused:
and what actually be the Termination process of h1b

I'm concurrently filing 140 and 485 at NSC (my application shd be out in 2-3 days). I've obtained a waiver and my J-1 expires next year Aug 2008. What do you guys feel that if this much time is enough to obtain the decision regarding those two applications. I'll be getting my and wife's EAD in 3 months. Should I used EAD after my J-1 expries or else I move to H-1 a month before it expires. Presently my wife is working in a private company (j-2 EAD). My lawyer discouraged me by saying that my applicaation could be rejected as J-1 is non-immigrant intent visa?? Please reply...

USCIS has updated the H-1B cap count. (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=138b6138f898d010VgnVCM10000048f3d6a1RCR D&vgnextchannel=91919c7755cb9010VgnVCM10000045f3d6a1 RCRD) As of December 8, CIS has received approximately 61,500 cases against the regular (non-Master's) H-1B cap of 65,000. However, since CIS sets aside up to 6,500 of this 65,000 for nationals of Chile and Singapore, it is possible that they will stop accepting other H-1B petitions soon, if not already. We are still filing new petitions, but with fingers crossed that they are not too late. If you need to file, please do so ASAP.

Hi My wife's H4b status is valid till 6th sept. Now she has her h1b approved on 3rd july. Her employer states that the approved petition has some clause that she has to leave the country and come back with h1 on nov 1st. Both the employer and myself are not comfortable doing that.
Her employer suggesting for h1b renewal under premium process so that i might get receipt in few weeks and also says that he would reapply for H1 wiht the receipt for the approval.
Please suggest me the best possible way ...

1. You can start a business. But you can't work or spend time on it. Just spend money and some one can run it. Silent owner.
2. Same applicable for H4.
If you have EAD, H1 & H4 can work in your own business and work in current H1.
H1 & H4 (without EAD) forget about starting business and sit in your own company/shop/gas station etc.... & MAKE MONEY. This is the fact.
Question: Can person A on an H1B start own business while continuing to work with current H1B job? Can the business be not related to ones profession? Can a person on H4 visa start his won business too? Any answer is appreciated!

I sent my application to vermont based on the USCIS answering system on June 30th that folks with approved I-140s should send 485 applications to the center where it was approved. Any ideas, if there is a problem with that and if the app gets transferred how much time it will take.
